The WCAB en banc rescinded the WCJ's April 19, 2022 Findings of Fact and Order and returned the matter to the trial level for further proceedings consistent with its decision, directing defendant to disclose all entities liable for payment and all insurance policies impacting liability, as required by Coldiron I and II and WCAB Rule 10390.
The WCAB granted defendant's petition for reconsideration, rescinded the WCJ's October 4, 2024 decision, and substituted new findings that the application ADJ18451814 was not duplicative of ADJ12117806, the presumption of compensability under Labor Code section 5402(b) does not apply, Dr. Jeffrey Nerenberg was validly obtained as QME, and discovery has not closed in ADJ18451814.
Petition for Reconsideration granted; April 8, 2022 Findings and Order amended to reflect that applicant's workers' compensation claim is not barred by Labor Code section 3600(a)(8).
