What the panel ordered
Petition for Reconsideration denied.p. 5
Lien Claimant CCPOA Benefit Trust Fund seeks reconsideration of the July 17, 2026 Joint Findings of Fact, Award, Order regarding reimbursement entitlement.
What was disputed, and how it came out
Each issue the panel decided, with the reasoning it gave. An outcome is what this panel did on this record — not a rule, and not a prediction.
The Appeals Board found that lien claimant is entitled to reimbursement only for benefits paid during the period of temporary disability awarded, not for the entire period of industrial disability leave paid by the employer, based on Labor Code section 4903.1(a)(3)(A).
The facts that decided it
What the panel treated as outcome-determinative, and which side it favoured.
Favours Defendant prevailed
This amount was confirmed by the Appeals Board as the proper reimbursement amount under the statute, and no evidence supported a higher amount.

Labor Code section 4903.1(a)(3)(A)
The Appeals Board applied this statute to determine the scope of lien claimant's entitlement to reimbursement, limiting it to periods of temporary disability indemnity awarded.
From the decision · page 2(3)(A) If the appeals board issues an award finding that an injury or illness arises out of and in the course of employment and makes an award for temporary disability indemnity, the appeals board shall allow a lien as living expense under Section 4903, for benefits paid by a group disability policy providing loss-of-time benefits and for loss-of-time benefits paid by a self-insured employee welfare benefit plan. The lien shall be allowed to the extent that benefits have been paid for the same day or days for which temporary disability indemnity is awarded and shall not exceed the award for temporary disability indemnity. A lien shall not be allowed hereunder unless the group disability policy or self-insured employee welfare benefit plan provides for reduction, exclusion, or coordination of loss-of-time benefits on account of workers’ compensation benefits. (§ 4903.1(a)(3)(A); emphasis added.)
