What the panel ordered
Petition for reconsideration denied; petition for removal dismissed.
Petition for reconsideration of the Order Appointing New Joint Liaison Counsel issued by a WCJ on June 3, 2025, filed by State Compensation Insurance Fund (SCIF) and denied by the WCAB panel on August 25, 2025.
What was disputed, and how it came out
Each issue the panel decided, with the reasoning it gave. An outcome is what this panel did on this record — not a rule, and not a prediction.
The petition was denied because SCIF failed to provide specific evidence supporting its claims and the legal arguments against its appointment as liaison counsel were previously rejected by the Appeals Board.
From the decision · page 1State Compensation Insurance Fund (SCIF) seeks reconsideration of the Order Appointing New Joint Liaison Counsel (Order) issued by a workers' compensation administrative law judge (WCJ) on June 3, 2025.1 The WCJ ordered that SCIF and Travelers Property Casualty Company of America (Travelers) be appointed the new "Joint Liaison Counsel" in this consolidated proceeding and that together, counsel for SCIF and Travelers are to coordinate and conduct all discovery, serve all minutes of hearing, communicate with all other defendants regarding discovery plans as set forth in detail in California Rule of Court section 3.506 (Cal. Rule of Court, § 3.506) and in the Order.
The facts that decided it
What the panel treated as outcome-determinative, and which side it favoured.
Favours Defendant prevailed
This fact undermined SCIF's argument that it should not be appointed liaison counsel due to fewer viable liens.
The matter is consolidated under WCAB Rule 10396, not Labor Code section 139.21, and concerns common defenses to liens, not merits of individual liens.
Favours Defendant prevailed
This clarified the scope of the proceeding and justified the appointment of liaison counsel.
SCIF has the same duty to defend against potentially fraudulent lien claims as any other workers' compensation carrier and can act as liaison counsel under the Insurance Code and Labor Code.
Favours Defendant prevailed
This legal duty supported the denial of SCIF's petition to avoid liaison counsel responsibilities.
From the decision · page 5[W]e concur with the WCJ that the petition's contentions that SCIF somehow lacks authority to act as any other workers' compensation carrier in these consolidated proceedings are unavailing. (See Ins. Code, § 11778 ["The fund may transact workers' compensation insurance required or authorized by law of this state to the same extent as any other insurer..."]; Courtesy Ambulance Service v. Superior Court (1992) 8 Cal.App.4th 1504, 1513, 1515, fn. 9, 1516 [SCIF is "in its purpose and everyday function...indistinguishable from a private corporation"; Legislature intended SCIF to be self-supporting (Lab. Code, § 11775) and competitive with other insurers].)2 SCIF provides no specific exemption in the California Constitution, the Labor Code, or the Insurance Code that would preclude SCIF from acting as liaison counsel in a consolidated workers' compensation proceeding.

- A published decision of the California Workers' Compensation Appeals Board, taken apart by what it turned on. The Board publishes the decision itself; this page adds the extraction and quotes the passage behind every claim.
