What the panel ordered
The WCAB dismissed the Defendant's Petition for Reconsideration as premature and returned the matter to the WCJ for further proceedings treating the Petition as a Petition to set aside the Awards.
Defendant filed a Petition for Reconsideration of the WCJ's Awards approving stipulated settlement agreements, which the WCJ recommended dismissing and treating as a Petition to set aside the Awards.
What was disputed, and how it came out
Each issue the panel decided, with the reasoning it gave. An outcome is what this panel did on this record — not a rule, and not a prediction.
The WCAB found the Petition premature and lacking sufficient record to determine mutual mistake, thus dismissing it and returning the matter to the WCJ for further proceedings.
From the decision · page 5We agree with the WCJ that it is unclear whether there was a mutual mistake, as alleged by defendant, or whether the mistake is actually a unilateral misunderstanding. The WCJ recommends that we dismiss the Petition and instead return the matter to him to consider it as a Petition to set aside.
