What the panel ordered
The Workers' Compensation Appeals Board denied the defendant's Petition for Reconsideration.
Defendant sought reconsideration of the Findings of Fact issued by the WCJ on June 30, 2023, which the WCJ recommended denying, and the WCAB panel adopted and incorporated the WCJ's Report and Recommendation.
What was disputed, and how it came out
Each issue the panel decided, with the reasoning it gave. An outcome is what this panel did on this record — not a rule, and not a prediction.
The WCJ found substantial evidence that applicant sustained injury AOE/COE to his right shoulder and that the date of injury was October 15, 2020, which is after the termination notice date, thus the claim is not barred by the post-termination defense.
