What was disputed, and how it came out
Each issue the panel decided, with the reasoning it gave. An outcome is what this panel did on this record — not a rule, and not a prediction.
The Board found that the more salient question was whether the injury was a compensable consequence of the prior industrial injury, not the applicant's employment status at the time. The record lacked sufficient evidence on the nature and circumstances of the claimed injury, requiring further development and remand to the trial level.
From the decision · page 6Here, the parties have litigated the issue of employment, submitting for decision the question of whether applicant was employed by Kelly Services at the time of his 2018 injury, which in turn was allegedly sustained pursuant to the award of medical treatment for an underlying 2007 back injury. However, we believe the more salient question is not applicant's employment status in 2018, but rather whether the alleged injury is a compensable consequence of the April 17, 2007 injury.
