The WCAB found that the QME Dr. Tirmizi's opinions were not substantial evidence because he did not adequately explain his reasoning, relied on incorrect legal theories, and his deposition testimony was inconsistent regarding the nexus between work stress and the stroke. The Board granted reconsideration and remanded for further proceedings to develop the record with a supplemental report from Dr. Tirmizi.
From the decision · page 1Sally the applicant (the applicant), wife of deceased the applicant (applicant), seeks reconsideration of the Findings and Orders (F&O) issued by the workers' compensation administrative law judge (WCJ) on February 17, 2022, wherein the WCJ found in pertinent part that applicant did not sustain injury in the form of a cerebrovascular accident (CVA/stroke), arising out of and occurring in the course of employment (AOE/COE) on February 18, 2018.
